New Construction = New Title Challenges: What Realtors Should Know

But while new construction has its perks, it also comes with a unique set of title-related pitfalls that many agents don’t see coming—until it’s too late.

Here are the most common issues we see with new construction:

🔨 Open Permits or Contractor Liens: Subcontractors may not close out permits properly, or worse, file liens if payments were delayed or mismanaged.
📄 Incomplete or Inaccurate Legal Descriptions: Plats may not be recorded yet, or parcel numbers might not match what’s on the deed.
🏗️ Certificates of Occupancy (COs): No CO? No closing. It’s essential that the property has final approval from the municipality before transfer.
